What is the Family Court of Western Australia?
The Family Court of Western Australia operates under Western Australian legislation and Commonwealth legislation and Western Australia is the only state with it’s own Family Court. The court deals with a wide range of family law issues such as divorce, property disputes, parenting disputes, and child support issues. For child and property matters in relation to de facto relationships, the Family Court of Western Australia acts under the Family Court Act 1997 (WA). However, for married couples who want to divorce and make arrangements for children, property and spousal maintenance, the Court operates under the Commonwealth Legislation and the Family Law Act 1975 (Cth).
The court is presided over by judges, magistrates and registrars and offers a range of services to help people resolve their disputes such as mediation and conciliation.
